Kraftanlagen München will appeal against fine imposed by the Federal Cartel Office

Lausanne – In the context of an investigation for anti-competitive behaviour against various companies in the technical building services sector, the German Federal Cartel Office has imposed a fine of EUR 47.5 million on Kraftanlagen München GmbH, a divested subsidiary of Alpiq. Kraftanlagen München rejects the allegations and will appeal against the imposed fine.

At the beginning of 2015, the German Federal Cartel Office initiated preliminary proceedings against various companies in the technical building services sector, including Kraftanlagen München GmbH, on suspicion of agreements restricting competition relating to projects, which in some cases were awarded more than ten years ago from today. In the course of these proceedings, the German Federal Cartel Office imposed a fine of EUR 47.5 million on Kraftanlagen München.

Kraftanlagen München attaches great importance to fair competition and therefore cooperated fully with the authorities from the outset in order to support them in investigating the allegations in question. Despite extensive investigations, a law firm commissioned by Kraftanlagen München to clarify the facts of the case could not find any evidence of misconduct by Kraftanlagen München or the accused former employees. Kraftanlagen München GmbH is not aware of any wrongdoing on its part and rejects the allegations. This fine cannot be justified by either the factual or the legal situation. Kraftanlagen München GmbH will therefore pursue all available legal remedies in Germany and lodge an appeal.

On 31 July 2018, the Alpiq Group successfully closed the sale of its Engineering Services business, which also includes the Kraftanlagen Group, to Bouygues Construction. In the event of the imposition of a final, legally binding fine against Kraftanlagen München, the sales contract between Alpiq Holding AG and Bouygues Construction provides for the indemnification of the purchasing party by Alpiq.
